On June 15, 2005, the FCC’s Media and Wireless Telecommunications Bureaus released a Public Notice 1 providing a list of all proposals received during the AM Auction No. 84 filing window that were determined to be mutually exclusive with other proposals submitted in the filing window. The Bureaus also announced a settlement period ending September 16, 2005, for certain parties with proposals in the MX groups to enter into settlement agreements or otherwise resolve their mutual exclusivities by means of engineering solutions, and a deadline of September 16, 2005, for the submission of amendments addressing the analysis of certain applications under Section 307( b) of the Communications Act.
The Bureaus have received requests that these deadlines be extended, due to the disruptions to business, communications, and to certain potential transmitter sites resulting from Hurricane Katrina in late August 2005. Because of these disruptions, it will be difficult or impossible for parties affected by the hurricane to complete settlements and/ or prepare Section 307( b) submissions by the September 16, 2005, deadline. The FCC has found that these circumstances justify an extension of the Auction No. 84 settlement window period and the Section 307( b) submission deadline. They therefore have extended the period for Auction No. 84 applicants to file settlements or technical solutions, or to tender Section 307( b) submissions, as applicable, to October 31, 2005.
