As part of the transition from analog to digital television (“DTV”), the Commission established deadlines for television broadcast licensees and permittees (hereinafter collectively referred to as “licensees”) to complete the construction of their replicated or maximized facilities or lose interference protection. In this Public Notice we describe the ways in which licensees may demonstrate compliance with the upcoming use-or-lose deadlines and the requirements for filing a request for waiver to extend the deadlines, if needed. We also specifically address the requirements for stations currently operating under DTV Special Temporary Authority (“STA”). FCC ANNOUNCES IT IS PREPARED TO GRANT LPTV CONSTRUCTION PERMITS AFTER FINAL PAYMENTS ARE MADE. (DA No. 06-1256)

By this Public Notice, the Media Bureau, under delegated authority, announces that it is prepared to grant the construction permit applications listed in Attachment A of this Public Notice following the full and timely payment of the remaining balance of the applicants’ winning bids. Therefore, in accordance with the procedures adopted in the Broadcast First Report and Order, a lump sum final payment from the Auction No. 81 winning bidders listed in Attachment A must be received by the Commission within ten business days of the date of this Public Notice (i.e., by July 7, 2006). MEDIA BUREAU IS PREPARED TO GRANT CERTAIN AUCTION NO. 37 BROADCAST CONSTRUCTION PERMIT APPLICATIONS. (DA No. 06-1167)

On November 23, 2004, the Federal Communications Commission completed the auction of 288 FM broadcast construction permits (“Auction No. 37”).  By this Public Notice, the Media Bureau, under delegated authority, announces that it is prepared to grant the construction permit applications listed in Attachment A of this Public Notice following the full and timely payment of the remaining balance of the applicant’s winning bid.  Therefore, in accordance with the procedures adopted in the Broadcast First Report and Order, a lump sum final payment from the Auction No. 37 winning bidders listed in Attachment A must be received by the Commission within ten business days of the date of this Public Notice, i.e., by June 21, 2006.

FULL POWER TELEVISION AUCTION NO. 64 WINNING BIDDER APPLICATIONS ACCEPTED FOR FILING. (DA No. 06-1135)

The long-form applications (FCC Forms 301 or 301-DT) for the winning bidders in the Full Power Television Auction No. 64 listed in Attachment A have been found acceptable for filing. The Commission may return or dismiss any application if it is found, upon further examination, to be defective or not in conformance with the Commission’s rules.In addition, applications listed in Attachment A that are pending with associated petitions for waiver are accepted conditioned on resolution of such requests.
